Come back in buying at auction

What would you do?

Bought a pen of ewes at auction last week. As normal I go thru the pen and check a few teeth udders etc. did not check every ewe


Described as dry shearling ewes.

As per norm I brought them home and popped them in an isolation field. Checked them a couple of times and then this morning. I found one with mastitis. Bag swollen and hard.

Treated her just now.

I’ll ring the auctioneer later but I expect it’s a case of buyer beware.

Sold under LAA rules if nothing else was in place (like society sales), which should be available to see in every mart, somewhere.

I'd expect my money back, she's neither a yearling nor dry. Could be a simple mistake on the vendors part of course, but still a full refund due.

Ive sent pictures to auctioneer along with pics inc ear tags. Ill have to get the others all in to double check them see if there are any other older ewes in the bunch....

Will mostly come down to if it was a genuine mistake/ mix up when penning up at the market by the vendor and if they want to refund you and have the sheep back!

Will be so many days to notify the auctioneers of any problems.

That breeding sale you bought from had plenty of ewes from various vendors who said the shearling ewes had reared lambs this year so sounds like just a mix up by a vendor who had both shearling and older ewes in the sale.

A lot of hassle but the best way is to get in the pens and check all the sheep after you have bought them but before you load them as any problems can be sorted out there and then.

I always check Yearlings to be sure they have two teats. From a relatives bad experience many years ago. No use finding out the problem at Lambing.
I also learned the hard way two years ago, a bl__dy wedder slipped in (and it had two good teats).

You shouldn’t have a problem getting your money back there, you have 2 valid reasons, when one will do. I’ve never had any problems with vendors accepting the udders are wrong with less obvious issues than that, don’t expect the auction company to be much use though.

Update.

Auctioneer fully on side. That ewe is going back to culls once out of withdrawl, vendor to make good losses.

Just have to get the others back in to check teeth to make sure no others have slipped through the net...if they have then purchase price to be adjusted to reflect issue and time to sort.
Can’t really say fairer than that 👍

Get on with it, there’s a time limit on throwing things up
