Movement breach

Had an email today to say I will be fined 3% of SFP for movement breach after inspection found I had sent sheep to Newark in January 2020 and not recorded the movement.
Now I didn't sell any sheep in Jan 2020 and never sold any sheep at Newark ever!
How do I sort this mess out?

Reply with the second sentence above and tell them to sort it out and tell them you resent being treated like a criminal when you have done nothing wrong. That's what i did when i was fined more than that for allegedly claiming 60ha of my neighbours which i hadn't....

I would like you to ask Janet Hughes how this happens......


And more importantly ask why there is no ombudsman to arbitrate when RPA, EA or Natural England make mistakes and serve punishment with no redress.

when we bought the neighbours about 12 years ago, I went to claim payments (I bought entitlements to suit) and was told it was already on someone else's IACS. I had to take the deeds in to prove it was mine. They would not tell me who had been claiming on it! Data protection or some such. I suppose I could have done a freedom of information claim, but to be honest I wasn't that bothered. Les who be bought from had horses, so didn't claim, therefore the land was not being claimed for.

Basically you are screwed as they will hold the BPS till its resolved if you pursue it, so you take the 3% fine and wait till god knows when for the 97% or lube up and take it like a good boy.

Been there and got the T shirt and i have an inspection report saying no issues found but they still fined me 2% for undeclared parcels. The RPA would struggle to deliver a dominos..............

Quick update - had a phone call yesterday to say they are dropping the case as they cannot get a copy of the (alleged) movement from Newark, little disappoined really as I was looking forward to seeing who had actually done the movement! It was apparently an electronic movement but my dad always did the sheep movements and didn’t have a computer, so always sent in the paper copies.
Edit.. suspect someone may have used our holding number to get around the 6 day rule

It has the ring to it that they think you did it but, out of the goodness of their heart, they're dropping the case 'cos they can't get a copy of (a non existant ) movement.

Bloody scandalous. They at least owe you an appology for their own mistake.

Just about sums them up, IMHO :mad:

Ask for all the details of the movement, including the copy of the licence which ARAMS will have if it existed.
If they cannot find this then they have no proof of any breach.

Send a letter by recorded delivery to whoever's name is on the paperwork. If there is no name then try phoning and get everyone's name.
I expect They wont give you any names , had an issue with Lloyd's about a claim I made for a credit card payment to be returned, it went on for months, had a right barney with a woman who refused to identify herself so I could make a complaint

On Thursday 26th September, we’re holding a webinar for farmers to go through the guidance, actions and detail for the expanded Sustainable Farming Incentive (SFI) offer. This was planned for end of May, but had to be delayed due to the general election. We apologise about that.
