What does working order mean?

A sprayer without caps,washers and nozzles is not in working order,

they will cost approx. £5 to £6 each body to fit.

As above its not that mistakes don't happen, its the way they are resolved that counts.

UK law is law.
A company cannot overide ligislation with their own terms and conditions. They can only enhane what the law requires.
An example - Maternity cover is law (whatever it is) an employer may say they will pay xxx whilst on maternity cover. If this is less than the law requires, the company is breaking the law. If it is better than the law requires - great.
Health and safety at work act canot be overidden - eg, you cannot say that if I come to work on our farm, any accidents are my own fault.
So, the way I understand the comment above, if someone says that a picture does not form part of the description of the machine when advertising it on ebay (for example), then they are wrong and are breaking the law.
The pictures form part of the description.

I may have misunderstood the original question though!

On the basis of you're argument.

You see a car on ebay sold in working condition, none of the pictures show the bonnet open. You buy it, have it delivered and it has no engine...............

You call the seller to protest and he says " it wasn't shown in the photos," so to use you're words "you're not getting them"

Don't be daft Man..................

The law is here to protect us against such nonsense.

I recently bought a second hand sprayer off a farmer and had a very similar experience.
I went to look at it and it had 2 sets of nozzles fitted. When it arrived in our yard it had no nozzles. After a few weeks of messages and phone calls they eventually sent me 2 sets of worn non matching flat fans. Not the original guardian air and 3d's that were fitted. Also set just 1 set of caps and no seals.
After further correspondence with them i recieved a letter that said that they had agreed to supply 2 sets of nozzles but didn't state that it would be the nozzles that were on the the machine[emoji35].
They were quite a few other issues and they haven't heard the last from me yet!

That’s a terrible way to do business, what is fitted to the machine when you view it unless specifically told otherwise is what you are buying, I always say “I want what I have paid more no more and no less” it’s not a difficult rule to understand in my book but still people cannot be honest.

It's a bit like saying it will come with 4 wheels the changing them for some bald split tires and then saying "but we didn't say which 4 wheels". Luckily i have a lot of text messages to prove all this and other issues. Unfortunately it looks like we are going to have to go down the small claims route.

Thanks to the likes of ebay however, the latest wheeze seems to be to strip an item before sending it on ( talking about farmers rather than dealers ) and flog parts on t'internet later.
Bottom cab steps anyone ? Drawbar ? 1000 rpm PTO stub ?Left turn indicator bulb ? :ROFLMAO:

Get the full text and email chain printed out ASAP. Good to have a hard copy to hand, I found in the past.

Done that. Even sent them a copy along with an invoice for missing parts, repairs not done that were in the agreement. Can't see that they have a leg to stand on but they seem to think otherwise.

Start the Small Claims proceedings, after giving due Notice and following all the necessary procedures. My experience is that the official letters will focus the mind of the other party... ?

If they failed to tell you the sprayer was supplied without nozzles, but was in working order, you are entitled to what you purchased, a sprayer in working order, nothing more nothing less. They have clearly failed to deliver on their part of the agreement, therefore you are entitled to return the goods and ask for a full refund + any direct costs you have incurred.

That is what you should do. It is also reasonable to set a time-frame on this to happen which is fair and reasonable.

Or, you can bite the bullet and buy the caps and nozzles elsewhere to get the sprayer working, and ensure the name of the offender is made clear to others so they don't fall into the same trap.

To avoid any comebacks or threats of deformation claims, ensure any information you post is fact........


Should have added, you can inform them they have an agreed time to put the sprayer in working order, if not done by then, then you will, and invoice them for the cost which should be all parts and labour required to put the sprayer in working order.

Would a ageing secondhand sprayer not be needing any existing nozzles replacing soon anyway? Unlikely to be a set on there without a good bit of age/wear anyway. Those that have posted only leaving one set in triple bodies wouldn’t be removing the oldest/cheapest either I suspect.

But yes, I’d expect a set in there, even if they hadn’t much life left in them.
Is true, but having to buy nozzles is one thing, having to buy nozzles, seals and nozzle bodies is quite another.
