The young PC was ok but a bit green. He asked if the ramps were secured properly or if they could fall out? I explained that they were held in and the lynch pin stopped the handle lifting and coming out. Was just waiting for him to try it for himself and nip his finger……..alas, he was more focused on typing on his tablet thing😀

I bought a net on Ebay. Someone was cutting pieces from condemned construction site safety nets and advertising them as cargo nets. Wasn't expensive and its been useful
 
Points are the annoying thing. That could be the outcome but have a bit of time to consider.

You won't win. They are like gravity. I was surprised they bothered to even stop you but they have done so and gone through the rigmarole of filling in the relevant paperwork. If you don't respond the fine will only increase.

Sadly I think this is the truth.


I could half understand them offering you the chance to go on a “load awareness course” if such a thing existed. Personally I think it would be a great idea if such courses were offered FOC by the government and people attended them every 5 years or so. Would do far more for safety than dishing out fixed penalty notices.

I similarly do not agree with points on people's licenses or speed cameras. I would sooner the police stopped people and said: 'errr you were driving a bit hazardously there, take more care please' instead of just busting people with fines and points but I don't make the rules.

Points are just a threat. The cost of a prosecution has to be subjected to some Regulations or a Test by the Prosecutor. I cant see that they will bother. Tell them you get DLA for serious mental health disorders. They will then send you £100.

General consensus seems to be that plod are being over zealous in this case. I need to try find info on load level and trailer sides. Wonder if there is a difference between goods operators and private individuals as to the rules?

I find it interesting that they say “alleged contravention” instead of just simply contravention. Also “or the manner in which said load was secured, was likely to cause danger of injury to any person there“ why wouldn’t they write “would” cause danger or injury…….

sounds like it’s open to be challenged

Can you ask them for the evidence of the “alleged contravention” to jog your memory on what they’re referring to? See if they have actually got anything.

Alleged is because it hasn’t been proven….yet. They would rather you admitted it than they had to take you to court and find you guilty. That costs them time and money. It would also cost you plenty too.

The system is skewed in their favour so the individual cannot seek justice without spending a fortune. The threat of that cost makes people cave in and just pay up.

Problem is there are rules which require a load to be secured sideways and from tipping out. If your trailer overturned then the load would not be secure. I think this is the issue you have.

That is the probably the case
 
Problem is there are rules which require a load to be secured sideways and from tipping out. If your trailer overturned then the load would not be secure. I think this is the issue you have.
I think it is just under normal circumstances and overturning wouldn’t be normal. The tarp and 2 ratchets wouldn't have kept any logs in if it couped over.
